Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using this service or website (the “Service”) operated by compunect, and its legal owners ("us", "we", or "our").

Your ("You", "Client", "Customer", "User") access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms of Service apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Purchases

If you wish to purchase any product or service made available through the Service you may be asked to supply certain information relevant to your purchase including: name, email address, billing address and business details.

You represent and warrant that: You have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase, the information you supply to us is true, correct and complete. You expressly agree that we are not responsible for any loss or damage arising from the submission of false or inaccurate information.


We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the product or service description or price, error in your order or other reasons. You expressly agree that we cannot accept any liability for loss or damage arising out of such cancellation. We reserve the right to refuse or cancel your order if we suspect fraud or an unauthorized or illegal transaction.

You may not create an account or purchase our service if you are affiliated with Google,Bing or LinkedIn.

Settling Disputes

Most disputes can be resolved informally, so if you have an issue with our services, let’s consult with each other first.

Before pursuing formal legal action, you agree to try to resolve a dispute with us informally by sending notice to support(at)scraping.services and giving Us 3 business days to respond.

Opening a card chargeback or a payment dispute is a breach of this Agreement and will result in either a handling fee or a permanent ban of Your account.

Credits

Monthly Credits attributed to a User's account wallet are reset at the end of each billing cycle.
 The amount of up to 10% of the User's license size will roll-over to the next billing month.

LinkedIn associated information

We are using solely legal methods to scrape and verify public profiles and companies from LinkedIn and are in no way affiliated with LinkedIn.

Our automated crawlers and processing algorithms only work with 'public available data', similar to major search search engine crawlers.

In the context of LinkedIn 'public available data' specifies personal information that has been configured by the person to be accessed by 3rd parties within their LinkedIn privacy settings page.

Any data purchased or leased from Us is intended only for the Client's internal use and needs to be handled with high care.

You may not use or abuse our data for any sort of illegal activities.  


Our data is primarily intended for: Statistical use, reports, research purposes


Every person has the right to request a full and permanent removal of their own personal data from our databases - contact our helpdesk to proceed.

We do not process or store 'sensitive personal information' from EU citizens including sexual orientation, health information or political views.

Our privacy team is always available to handle any questions or concerns.


Data privacy on LinkedIn

When an account owner on LinkedIn decides to terminate that account or remove it from public access we will also cease to access that data and initiate a data removal process.

When setting a profile to public the affected information will be spread to Google, Bing, Yandex, Yahoo and also be collected by Us.
If you are concerned about your personal data we recommend to review the current LinkedIn privacy configuration (upper right corner: Me > Settings and Privacy > Privacy ).

Sale conditions:
Sales are B2B oriented, intended to be used for internal purposes and only forwarded to your customers in highly filtered fashion.
LinkedIn data must not be published in public or sold/forwarded to other entities without our written permission.
Data must be stored in a secure manner to prevent unwanted access.

Data must be used in a lawful way and handled with apropriate care.
Direct resale or redistribution of obtained data to third parties has to be licensed (commission fee) (contact support).

Unlicensed resale is punishable by 200% regular licensing fees.


Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms of Service, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password or any related API credentials that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree that any cost generated by you or a third party using your credentials are under your sole liability. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Intellectual Property

The service and its original content, features and functionality are and will remain the exclusive property of compunect and its licensors. The service is protected by copyright, trademark, and other laws of both the Czech Republic, EU and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of compunect.

Termination and Blocks

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Limitation of Liability

In no event shall we, nor our directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service, any content obtained from the Service, unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Disclaimer of Warranites

Your use of the Service is at your sole risk. The Service is provided on an “as is” and “as available” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

EXCEPT AS OTHERWISE PROVIDED HEREIN, OURDATA IS PROVIDED ON AN "AS IS" BASIS, AND WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF SATISFACTORY QUALITY, ACCURACY, AND FITNESS FOR A
PARTICULAR PURPOSE OR NEED, WITH RESPECT TO THE DATA.

Exclusions

Without limiting the generality of the foregoing and notwithstanding any other provision of these terms, under no circumstances will We ever be liable to you or any other person for any indirect, incidental, consequential, special, punitive or exemplary loss or damage arising from, connected with, or relating to your use of the Service, these Terms, the subject matter of these Terms, the termination of these Terms or otherwise, including but not limited to personal injury, loss of data, business, markets, savings, income, profits, use, production, reputation or goodwill, anticipated or otherwise, or economic loss, under any theory of liability regardless of any negligence or other fault or wrongdoing (including without limitation gross negligence and fundamental breach) by Us or any person for whom Scraping.Services is responsible, and even if Scraping.Services has been advised of the possibility of such loss or damage being incurred.

Confidentiality

Both parties (We as well as the Customer) agree to not make public statements regarding the existence of our business relationship without written consent of the other Party.

Any documentation, discussion, emails, tickets designated by the disclosing party as confidential or should be reasonably be understood to be confidential shall be protected and safeguarded by the receiving Party with the same degree of care it protects its own confidential information.

If a Party is legally compelled to disclose any of the Disclosing Party’s Confidential Information, then, prior to such disclosure, the Receiving Party will (to the extent permitted by applicable law) cooperate reasonably with the Disclosing Party, at the Disclosing Party’s sole cost and expense, in protecting against any such disclosure and/or seeking a protective order narrowing the scope of such disclosure.


Indemnification

You shall defend, indemnify, and hold us harmless from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, arising or resulting from your breach of this TOS, any of Your Content, or your other access, contribution to, use or misuse of the Service. We shall provide notice to you of any such claim, suit or demand. We reserve the right to assume the exclusive defense and control of any matter which is subject to indemnification under this section. In such case, you agree to cooperate with any reasonable requests assisting Our defense of such matter.


Governing Law

These Terms shall be governed and construed in accordance with the laws of the Czech Republic / Prague  without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms of Service at any time. When we do such updates we revise the updated date at the bottom of this page. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the service.

Credits are based on average monthly API usage spent by user. If not applicable for the used type of API credits are determined by our Sales team.

Eligibility:
To be eligible for SLA credit refunds you must notify Help Desk when the problem occurs so the issue can be verified by Our staff.

Privacy Policy

Your privacy is important to us.

It is our policy to respect your privacy regarding any information we may collect.

Accordingly, we have developed this privacy policy in order for you to understand how we collect, use, communicate, disclose and otherwise make use of personal information. We have outlined our privacy policy below.


Summarized we do request browser cookies, we store the IP address of API and website usage for security purposes.

We do not sell or provide your entered data to third parties and we don't keep data for longer than necessary for the purpose we collected it.

We treat your data, your entered jobs or keywords with high respect, your trust in our professionalism is part of our business.

We do not store cleartext passwords, instead we use salted one-way hashing technology.

Our servers and databases are all hosted in the united states and protected by customized firewalls.

Our websites and API offer HTTPS as default access method which is a sufficient transport encryption.
